1. What is the new plan for the pool project?
The 4,200 square foot clubhouse has been replaced by a 1,000 square foot one-story building with the following features required for the Pool Facility:
● Changing rooms, restrooms, showers, cubbies
● Pool and HVAC equipment
● Furniture and equipment storage
These changes allow for an increase in deck size, grassy area and parking to provide for additional pool capacity.
2. Why wasn’t this the original plan?
The current pool committee adopted the plans for the pool project as designed by the first pool committee back in 2007. Additionally, the PMA Board originally thought a community clubhouse available for meetings and large gatherings would be a desirable benefit for the entire Pinebrook community and the current PMA Board expected the pool committee to proceed with the clubhouse as part of the plan. After receiving community feedback that the cost for the clubhouse was too great, the current PMA Board agreed to the current pool committee’s request to eliminate the clubhouse to reduce the project cost. Instead of gaining the benefit of a clubhouse for the community, the PMA will now benefit from annual lease payments from the PRC, initially set at $10,000 per year.
3. What is the new cost for membership?
The reduced budget allows for more economical membership options for households of different sizes and single memberships. There are now three membership options at different prices:
● Household membership (adult and 2 or more household members) at $6,500 (35% reduction)
● Dual memberships (adult and 1 or more household members only) at $5,250
● Single adult memberships at $4,000
All membership fees are fully refundable upon membership termination. There are no limits on the number of memberships currently. However, if capacity limits are imposed based on usage, purchasers of founding members’ homes will be able to join the pool immediately upon their purchase of the home.
4. How many members do we need to build the pool?
The PRC has budgeted $1.2 million for the cost of the pools, grounds, and one-story building. Because there are three membership categories with different membership fees, there is no specific number of memberships needed. Rather, we need 185 “Household Equivalents” calculated as 1 for a Household membership; 0.8 for a Dual membership and 0.6 for a Single membership. Part of the budget may be satisfied with a loan which will reduce the amount of Household Equivalents required.
5. Can I change my membership category?
Yes, membership category upgrades are always permitted upon payment of the additional fee (the difference between the cost for the new category and amount already paid). Downgrades will be considered annually before the budget for the next year is set and will be granted (and refunds of the difference in fees made) as long as the number of Membership Equivalents does not decrease from the current year’s Membership Equivalents.
6. How do I sign up?
Download the Membership Agreement and return an executed signature page and your $250 deposit. The Membership Agreement is on the “Documents” page on this website and it includes instructions on where to send your executed signature page and where to mail your deposit.
7. When are membership fees due?
This depends on when the PRC can begin construction. The Membership Fee will be due in two payments; the first prior to construction (hopefully Fall 2021) and the second during construction.
8. When will the pool open?
The pool committee still hopes that the pool can open during the summer of 2021 and will make every effort to make that happen. However, the actual pool opening will be highly dependent on when the PRC obtains sufficient membership commitments as it cannot secure a pool builder until that time.
9. What happens if I want to terminate my membership?
Membership fees are fully refundable when you give up your membership, provided the number of members (referred to as “Household Equivalents”) will be the same after termination as at the beginning of the year termination is requested. If that cannot be met, a waiting list will be maintained and terminations granted in the order received once additional memberships are obtained.
10. How much are annual maintenance fees?
Annual maintenance fees for the first year of operation are set at: Household = $985; Dual = $785: Single = $585. There may be a reduction in the first year fees if there is a delay in opening. Future years’ fees will depend on the operating budget and the number of Membership Equivalents.
11. Who can join?
All owners of a residence in the Pinebrook Master Association. If your residence is not part of the PMA but you live in Pinebrook, you can join the PMA individually and then join the PRC.
12. I live in Pinebrook but I am not part of a homeowners association that is part of the PMA. How much will it cost me to join the PMA so that I can become a Pinebrook Recreation Center member?
You can join the PMA by paying the following two amounts: $400 that every home in Pinebrook was initially assessed to become a member of the PMA plus $360 that every home in Pinebrook was subsequently assessed to build the Pinebrook Park in 2003. In addition, you will be required to pay the annual assessment applicable to PMA members. The annual assessment entitles your household to use the Pinebrook Park and the Pinebrook Master Association trail system. The annual assessment for 2021 is $128. 13. If I am building a residence in Pinebrook, can I join the Pinebrook Recreation Center before I move into the neighborhood?
If you own the land already and if you are paying assessments to the PMA, you may join the PRC.
14. Why isn't this funded by the Pinebrook Master Association so everyone can use it?
The land for the pool was set aside in the mid-1990’s when the PMA park was first planned. Many community members wanted the PMA to assess all members for the cost of the pool facility so it could be completed with the park, but the PMA board felt at the time, and still feels, that such a facility should be funded instead by those who will use it. The decision was made then to make the land available to a non-profit association of PMA members as an optional amenity that could benefit the entire community, in exchange for some other benefit for the PMA membership. The PRC will make annual lease payments to the PMA for use of the land. However, the Pool must be funded through membership fees (for building costs) as well as annual maintenance fees (for operating costs and to establish and build reserves) from those that wish to join.
15. I made a deposit years ago. What happened to it?
All deposits previously received are still being held and you do not need to make another deposit. If you are no longer interested in joining the PRC and would like your deposit refunded, send an email to [email protected].
16. Are you limiting the number of memberships?
Because the new building will have a significantly smaller footprint, there will be more deck and grassy area, and therefore the PRC has not placed a limit on the number of memberships at this time. However, depending on actual and anticipated use and capacity, the PRC may place limits on Memberships in the future to ensure the PRC will not be overcrowded and therefore can safely and comfortably accommodate all members.
17. Is my membership transferrable?
Because the PRC does not anticipate placing limits on the number of memberships, transferability would not be necessary because anyone who wants to become a member can become a member. If there is a limit imposed, a waiting list be maintained. However, a purchaser of a founding member’s home (the first 185 Membership Equivalents to join in 2021) will be able to join without being placed on the waiting list.
18. If we buy a membership now, can we sell it later for a profit?
No, memberships cannot be sold.
19. Will a membership have to be sold with our property if we decide to move somewhere else in Pinebrook?
No, if you move to another residence within Pinebrook/PMA, you may retain your membership.
20. Can we keep our membership if we move out of Pinebrook?
It depends. Membership is limited to PMA members, so moving out of Pinebrook may terminate your membership. However, if there are not sufficient members (“Household Equivalents”) when you move, you will retain your membership temporarily until additional members join.
21. Where can I learn about the physical specifications of the pool facilities?
Please see the “Features and Costs” page on this website. However, because significant changes to the scope of the project are being made, the PRC will need to obtain new architectural plans and construction drawings once sufficient Membership is obtained.
Access / Guests / Rules / Accessibility
22. Can my renters use my membership?
If you rent your residence for at least 30 days, your renters may use your membership (in place of your household members) during their rental period with advance written notice to the PRC.
23. Who will have access to the pool facility?
The Member and designated household members according to the membership category will receive full access to the facility. All others will be considered guests and be subject to the Guest Policy.
24. Is there a limit on how many people can use each pool at one time?
Yes, State and local law impose limits on maximum occupancy. There may be additional COVID-19 related restrictions based on local health regulations.
25. Will the building and pools be handicap accessible?
Yes, there will be ADA accessible entrances and the main pool will have a mechanical chair lift that can lower individuals into the pool.
26. Will the facility be open all year?
No, Annual maintenance fees are based on operating the pool from Memorial Day through Labor Day. Once the pool is operational, the members and Board can evaluate the interest in keeping the facility open for a longer season and member appetite for increased fees associated with that.
Safety / Staffing / Liability
27. Will there be a lifeguard on duty?
No. The pool will not be staffed with lifeguards. This is not required by Utah or Summit County regulations, and the costs associated with lifeguards would result in much higher Annual Maintenance Fees. Parents are required to supervise their children carefully (see the “Rules” page on the website for additional information). All members and guests will be required to sign liability waivers.
28. Will the pool be staffed?
It is possible that the pool facility will be staffed during some of the summer days when we anticipate high usage by members.
29. What steps have been taken to protect the PMA and its members from liability?
Protecting the PMA and its members from liability exposure has been an overriding objective since the beginning of the planning for the pool project some 25 years ago. It has always been agreed that the PRC would have separate insurance which also listed the PMA as a named insured, and that the PRC would hold the PMA harmless against all claims. The PMA and the pool committee have evaluated and considered the liability risk and consulted legal counsel to make sure those goals are met. The pool committee has consulted a reputable insurance broker that provides liability insurance to some of the Pinebrook HOAs and has budgeted for a $10 million liability policy. These days anyone can be sued, but the risk that the PMA as a land-owner leasing property to another separate legal entity would be liable in the event of a lawsuit is very slim and is most effectively addressed through adequate insurance. The PMA already insures against the significant risks inherent in owning and operating a park and maintaining an extensive trail network on its 500+ acres of open space. The PMA currently maintains $3 million of liability insurance coverage to protect the PMA and thereby its members against those risks and will further evaluate the adequacy of its insurance policies upon completion of the pool facility. Increased insurance limits are not expensive and provide the most cost-effective protection available against possible lawsuits. It will also be in the PRC’s own interest to take all reasonable steps to mitigate risks to itself, and by extension to the PMA and its members, relative to the pool project.
30. What if I have questions about the Pinebrook Recreation Center, my membership, or how to access the PRC, after joining?
A professional management company will be hired to manage the day-to-day affairs of the PRC and will be supervised by the PRC’s Board of Directors. Members will be provided with information regarding how to reach the management company.
